These Terms govern your use of VIRALCADE (the “Service”), operated by Brandun Entertainments (the “Company”, “we”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service does
VIRALCADE is an automated tool. You upload a video file and its subtitles; the Service generates a narrated recap video plus a thumbnail and titles, and returns them to you. We are a neutral processing tool. You decide what to upload, what to generate, and whether and where to publish the output.
2. Your content and your responsibility
You represent and warrant that, for every file you upload, you own or have all rights, licenses, and permissions necessary to upload it and to create and publish a derivative recap of it. You are solely responsible for your use of the Service and for any content you generate or publish.
- You are the author and publisher of any output you post. We do not publish anything on your behalf (unless you separately enable an automated-upload feature, in which case you direct and authorize each upload).
- You will not use the Service to infringe copyright, trademark, publicity, or other rights, or to violate the rules of any platform you post to (including YouTube’s policies on reused or inauthentic content).
- You grant us a limited, revocable license to process your uploaded files solely to provide the Service (transcode, generate, deliver). We do not claim ownership of your inputs or outputs.
3. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its operators from any claim, demand, loss, liability, or expense (including legal fees) arising out of: (a) content you upload or generate; (b) your publication or use of any output; (c) any copyright, Content-ID, DMCA, right-of- publicity, defamation, or platform-policy claim relating to your content; or (d) your breach of these Terms.
4. Acceptable use
- No uploading content you lack the rights to; no unlawful, infringing, or hateful content; no content depicting minors unsafely.
- No adult or sexually explicit content. This covers material whose primary purpose is sexual gratification, in any form. Uploads that breach this are rejected and any credits spent are returned.
- No automated abuse, scraping, reverse-engineering, or attempts to extract our models, prompts, or pipeline.
- No reselling or sublicensing the Service itself.
- We may suspend or terminate accounts that violate these Terms or that we reasonably believe create legal risk, including repeat infringers (see our DMCA Policy).
5. Credits, payment, and plans
The Service runs on credits. Most engines bill 1 credit per second of finished output; Animated Documentaries bill 2 credits per second, and the Sleep Engine bills 1,000 credits per hour of video (600 minimum). The cost of a render is shown before you start it. Credits and plans are described on the pricing page. Payments are processed by our third-party payment provider; your purchase is also subject to their terms. Refunds are governed by our Refund Policy. Automation is not a credit plan. It is a managed service billed per channel; its billing and refund terms are set out in section 6 below and in the Refund Policy, and Automation fees are non-refundable once work has begun.
Subscription credits are allotted on a monthly basis and are valid for the billing month in which they are granted; unused credits do not roll over or carry forward to the next billing period. Each renewal replenishes your allotment in full.
Pricing is not fixed. Prices, subscription fees, credit costs, and what a credit buys - including the credits charged for a given engine, voice, resolution, or output length - may change at any time, whether anincrease or a decrease, at our sole discretion and with or without notice. Pricing may be adjusted as our own costs change, including as we add or rely on new or third-party technologies, models, higher-quality voices or audio, or additional processing. Any change to a recurring plan’s price takes effect on your next renewal (you may cancel before then); changes to per-render credit costs apply to new renders from the time of the change.We are not liable for any pricing change, and your continued use of the Service after a change constitutes acceptance of it.
6. Managed service (Automation)
Automation is a managed service billed per channel. The monthly output stated on the pricing page is the standard allocation per channel and assumes standard long-form and short-form production.
Formats that cost materially more to produce may carry a different allocation. Animated output, in particular, costs substantially more to render than standard output. Where a channel’s format calls for animation or for other higher-cost production, the monthly volume for that channel may be adjusted, or a different price agreed, in place of the standard allocation. We will confirm this with you before any such work begins, and you may decline and remain on the standard allocation.
Stated volumes are targets for a full billing month and assume we have what we need from you to proceed, including channel access where the channels are yours. Where a month is interrupted by matters outside our control, we will make the shortfall up in the following month rather than reduce the fee.
Automation fees are non-refundable once work has begun. Production, research and scheduling start as soon as we have access, so a billing month that has been worked cannot be refunded. You may cancel at any time and it takes effect at the end of the current billing month, with no further charges after that. Where we have not yet started work on a new billing month, contact us and we will deal with it fairly.
Introductory pricing, where offered, applies to the first billing month only; the recurring rate is stated on the pricing page and at checkout before payment. Custom packages are billed at the agreed flat rate with no introductory discount unless stated in writing.
7. Outputs and watermark
Outputs may carry a “Made with VIRALCADE” mark depending on your plan. Quality is automated and not guaranteed to be fit for any particular purpose; you review every output before publishing.
8. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or that outputs will avoid copyright claims, Content-ID matches, or demonetization on any platform. No tool can guarantee this; you accept that risk.
9. Limitation of liability
To the maximum extent permitted by law, the Company’s total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the three (3) months before the claim. We are not liable for indirect, incidental, or consequential damages, lost profits, lost views, or platform penalties.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or legal risk. Unused credits are non-transferable; see the Refund Policy.
11. Governing law
These Terms are governed by the laws of India, and the courts of India have exclusive jurisdiction, without regard to conflict-of-laws rules.
12. Right to modify the Service and these Terms
We reserve the right, at our sole discretion and at any time, to add, change, suspend, limit, or discontinue any part of the Service - including features, availability, plans, pricing, promotional offers, credit values and costs, output formats, quality, and any watermark - and to modify these Terms, the Refund Policy, and any other policy, with or without notice. Where practical we will post the updated “last updated” date; it is your responsibility to review the current version. Your continued use of the Service after any change constitutes acceptance of that change. If you do not agree, your sole remedy is to stop using the Service.
Nothing in these Terms obligates us to maintain any particular feature, price, or promotion, or to provide the Service on an uninterrupted or error-free basis. You are solely responsible for your account, your uploads, your generated outputs, where and how you publish them, your compliance with all applicable laws and platform rules, and any consequences arising from any of the foregoing.
